Honda Obtains Injunction over Use of Its Motorcycle Design in Nigeria

Honda Motor Company Ltd. and Honda Manufacturing (Nigeria) Limited have obtained an Interim Injunction against the use of its motorcycle design in Nigeria. 

In a lawsuit filed through their lawyers, Stren & Blan Partners (instructed by IPvocate Africa), against Sonlink Industry Western Africa Co., Ltd on 14th April 2023 at the Federal High Court, Lagos alleging design infringement of its motorcycle,

The Court heard and granted Honda’s application on 3rd May 2023 as follows:

The Court granted that the Plaintiffs sue the Defendant on behalf and as representing all members of the class of persons defined as engaged or taking steps to engage in the use, trading, distributing etc., of the SONLINK JCKA SL100-A and any other motorcycle with similar variation of the motorcycle infringing the Plaintiff’s registered design no. F/RD/2016/0538.

The Court granted an Interim Injunction against the Defendant that restrained them from infringing the Plaintiff’s registered design by manufacturing, importing, exporting, branding, marketing, distributing, selling, or reproducing the Defendant’s product SONLINK JCKA SL100-A and any other motorcycle with similar variation of the motorcycle infringing the Plaintiff’s registered design no. F/RD/2016/0538.

The Court granted that the Plaintiffs can advertise any Order of the Court made in this lawsuit in two national newspapers throughout Nigeria
