In Property management the Estate Surveyor Oversees the daily operations of properties acting between the landlord and the tenant. these landlords and tenants have their rights and responsibilities.
A landlord is an individual or entity (e.g. government body or institutions) providing housing for persons and Organizations that requires it for their purpose in consideration of rent which can be annually, monthly or as agreed by the parties. A tenant is a person who occupies the property of another for his use in consideration of rent. Rights are legal power, authority and entitlement to something.
As a property owner, a landlord has several rights regarding his property which includes Right to collect rent from the tenants as agreed upon in the lease or rental agreement, Right to evict tenants for non-payment of rent or breach of lease terms, or other valid reasons, following the legal eviction process. Right to maintain and repair the property including entering the premises for necessary inspections and repairs. Right to set terms of the lease or rental agreement, including rent amount, lease duration, and other conditions. Right to sell the property subject to any existing lease or rental agreements. Right to recover damages caused by tenants’ negligence or intentional acts. These rights must be in Compliance with the local, state, and federal laws, including fair housing laws and building codes.
A tenant also has several rights that are protected by law. Right to habitable premises a safe, secured environment. Right to quiet and peaceful enjoyment of the property, free from disturbances. Right to notice before landlord enters the property, except in emergencies.
Right to request repairs and maintenance to ensure the property remains habitable. Right to protection from retaliation by landlords for exercising their rights. Right to fair housing with no discriminating factors like race, colour, national origin, sex, disability, and family status. Right to security deposit protection handled according to the law, including receiving interest and getting the deposit back when they move out. Right to a lease agreement that outlines the terms and conditions of the tenancy. Right to terminate their lease under certain circumstances, such as military deployment or domestic violence.
