The records of the appeal filed by the Governor-elect of Zamfara State, Alhaji Mukhtar Shehu and 37 others against the judgment of the Court of Appeal, Sokoto Division, has been transmitted to the Supreme Court.
The appellate court had about three weeks ago ruled that there were irregularities in the conduct of the All Progressives Congress (APC) primary in the state.
The Supreme Court though was said to have received the records of appeal last Thursday, April 11, THISDAY gathered from the registry of the court that no date has been fixed for the hearing of the appeal.
An official at the registry explained that parties in the suit are expected to file, serve and exchange briefs before a date can be fixed for the hearing of the matter.
The case has also led to the non- issuance of Certificates of Return to the governor-elect, and other members of the State House of Assembly.
The Independent National Electoral Commission (INEC), withheld the Certificate of Returns of APC elected candidates in the state, after the elections.
However, because of the urgency of the matter, the source revealed that the court may likely abridge the stipulated timeframe.
The governor-elect recently wrote to INEC Chairman, Prof. Mahmud Yakubu, drawing his attention to the notice of appeal filed at the Supreme Court.
In a letter dated April 2, Idris, had through his counsel, Mahmud Magaji (SAN), said the purported judgment of the Court of Appeal, has no positive or direct order.
He argued that assuming there was even a court order arising from the said judgment, they still have 21 days to appeal, thus putting into abeyance the said judgment until after the 21days elapsed. He maintained that in the case at hand, the party still have 21days existing side-by-side with their constitutional right of appeal.
