Saraki’s Trial: Desperate Politicians have Hijacked CCT – Kwara APC Claims

The All Progressives Congress, APC, Kwara State chapter, has raised the alarm that ‎desperate politicians in the country have hijacked the Code of Conduct Tribunal (CCT), warning that the judiciary may throw the country into needless chaos and pandemonium in view of the ugly development.

In a statement issued in Ilorin by the party on Sunday signed by its state Publicity Secretary, Alhaji Sulyman Buhari, the party said, “President Muhammadu Buhari should not be seen to be watching helplessly when politicians hijack a crucial arm of the government to carry out political vendetta against perceived political adversaries”.

According to the statement, “For anyone who ever doubted our position that the trial of the Senate President is not an anti-corruption drive but political persecution and witch-hunt, ‎the ruling of the tribunal last Thursday i‎s the clearest signal that what the Senate President is going through is nothing but political persecution at the tribunal”.

The statement said,”lIt also shows that the CCT is being manipulated and remote-controlled by some desperate politicians”. 

The APC said further that, “Like the c‎ounsel to the Senate President rightly noted, we are convinced that the right thing has not been done as far as the charges are concerned. It is now clear and glaring that due process has not been followed and the CCB has broken its own laws”.

 “Given identical cases, Nigerians should note that the CCT under Justice Umar Danladi discharged and acquitted a leader of APC in 2011 based on Section 3 (d) of the CCB/CCT Act. Why is the Senate President’s motion on the same Section 3 (d) of the CCB/CCT Act being denied by the same tribunal under the same Judge?”, the party queried.

SARAKI MUST VOMIT OUT 3 TRILLION NAIRA WORTH OF PROPERTIES GOTTEN BY ILLEGITIMATE MEANS AND ALL HIS NIGERIAN AND DOLLAT ACCOUNTS FROZEN.       Why is section 3d obsolete, are u a lawyer,if u re has anything change in the 1999 constitution for u to say section 3d is obsolete, as much as we agreed on the fight against corruption, it’s totally wrong for the Senate President to be persecuted, there can not be different interpretation for the same issue

        you are a bit confused, saraki is not being persecuted but prosecuted for his evil deeds to the nigerian society. he will be punished according to the laws of the land, tribal sentiments and sycophancy aside.
        yes, law has changed not the same as in 1979 according to which tinubu was acquitted but then tinubu will be tried again and punished according to the new laws of the land. yes i am the senior advocate of nigeria.

          I laugh in Spanish for u calling urself a Senior Advocate of Nigeria any really SAN will not used he will be punished, because it means u re going against a fundamental and simple rule of law that says an accused is presumed innocent.

          Also if u re a SAN u should know that a judge cannot reverse it’s own judgement. Only supreme Court is allowed to reverse itself, it’s clear u don’t know anything about Law

    I can’t wait to see Saraki in prison because I believe that he is one of the biggest criminals alive in Nigeria. However, the
    Precedent APC and Buhari is setting will only deepen corruption and raise more rogues than curb the menace. Double standard is what APC is deploying in this so called corruption fight and it’s a big monster that will come back to hunt Nigeria if not nipped in the bud.

      Yes, it’s double standard which is not good for the government, and aside dt a judge cannot reverse it’s own judgement, it’s only supreme Court dt can reverse it’s own judgement

    The reason is simple. Tinubu was discharged because the pre condition specified in 1979 constitution was not met. However, that precondition was expunged in the 1999 constitution. Saraki is being tried under new law.
    Most issues Saraki placed before the Tribunal including jurisdiction had been resolved by the Supreme Court. Pro Saraki supporters should stop crying wolf where there is none. May i also remind the town cries that Saraki became Senate President under a new rule so what goes around comes around!

      Was Tinubu case tried before 1999 or has anything changed in 1999 constitution between when Tinubu was tried and now.

        Tinubu’s case was not before 1999. However his lawyer made the argument using points and authority from the old constitution which the Prosecution failed to counter. The Judge will only rule based on arguments made before him. Saraki could have also gotten away with it but Rotimi Jacobs opposed it on the ground that the issues raised no longer exist under the new constitution! A new law supersedes the old one. The condition precedent under which Tinubu was discharged no longer exist. Judges dont make your argument, your lawyers do!

      Thanks much for ur constructive arguement, this is what discourse is all about, not just people talking for talking case. Ur points are noted however my own arguement is nothing has changed in the 1999 constitution between Tinubu case and this one, Rotimi Jacob only said they were misled with section in 1979 constitution, which is an error on their part, and let’s agree for the sake of arguement that this is no, the law is very clear that a court can not reverse or depart from his own except it’s judgement is overruled by a higher court, Only supreme Court can REVERSE itself u can’t build illegality on illegality.

        Thank you. I had a wonderful time in Church yesterday. Your argument that a lower Court cannot reverse itself is only applicable to its ruling in a particular case. Like in the case of Tinubu it cannot reverse itself but Saraki’s case its different. Law like every other thing evolves. The Constitution is supreme and any amended part of the constitution takes precedent over existing judgements. If today the Constitution is amended to allow third term in office for Presidents, you cannot insist on two terms based on previous Supreme court rulings. A precedent was set with Tinubu’s case but the Constitutional amendment has set it aside. I am not a lawyer but from a layman’s point of view i believe the Tribunal was right to deny Saraki’s application.

  • I am happy with the intresting comments in this regard. We dont need to be using abusive worlds on each other here. The rules of law should be follow, this is a direct case. But because APC are scared not to loose the seat to PDP, therefore this argument. He who blow d bipper detate the tune, Saraki betrayed Jonathan bcos he want to be senate Presido. He must make himself clear.

    The better we allow Kwarans comment on this report : let civil servants, artisans, tertiary institutions staff and students owned by KWSG, the ordinary people’s view in Kwara State should be objectively collated to determine how well or wicked Saraki built a legacy of regrets /pride in Kwara.
    Every man reap the seed he sowed. For Kwara where my children can stand, all hail the coming of Buhari that genuinely make it a no business as usual. Not minding the very selfish unimpactful Alfa Belgore (former CJN), Kwara and indeed Ilorin is crying for deliverance from the carnivorous who have buried us alive.

    1.Bukola takes a criminal pension far higher than he earned as sitting Governor
    2, In the era of surplus allocation from FGN, Bukola took bonds in billions that ended in his pockets.
    3. Bukola instituted poverty and retrogression as a policy since 2003, ask tertiary schs workers who earn 60% of their colleagues the country over and civil servants who as grade level 12 officer earn less a hundred thousand naira in Kwara.
