Female Banker Escapes Murder Trial over LASTMA Official's Death

Reprieve Tuesday came the way of embattled Mrs Yinka Johnson, the female banker who was accused of killing 33-year-old Hammed Balogun, a Lagos State Traffic Management Agency (LASTMA) official.  Although she will no longer face the murder charge arising from the accusation against her, she will now be tried for a milder offence: driving against the traffic.

Johnson, a member of staff of IBTC Bank Plc., was accused of knocking down the LASTMA official in a bid to escape arrest after driving against traffic.  However, she insisted that she neither hit the late Balogun nor killed him. She and her about three-month-old baby had been in police custody since Friday.

However, luck smiled on her yesterday when she was arraigned before the Igbosere Magistrate's Court on a one-count charge of reckless driving and not murder.

THISDAY gathered from a police source that although the banker’s case was initially treated as a murder case, it was soon to change after detectives from the Homicide Unit of the State Criminal and Investigation Department (SCID), Panti, Yaba, led by the Officer-in-Charge, Solomon Okechukwu, went to the accident scene to conduct a detailed investigation into the allegation that she killed the LASTMA official.

Based on the findings of the detectives which were further buttressed by scores of eyewitness’ accounts, the murder charge was dropped.  Several eyewitnesses, who provided their names and statements, debunked the allegation of murder by LASTMA against Johnson. 

Faced with the unassailable evidence of her innocence, the police arraigned her before Magistrate Jacob Adegun on a one-count charge of reckless driving against oncoming traffic.

She pleaded not guilty to the charge and was granted bail in the sum of N50,000 with one surety in like sum. The matter has been adjourned till September 5 for trial.

Prosecuting Police Inspector, Oluwagbemileke Agoi, told the court that the defendant on August 10, at about 8:30am at Mega Chicken, Ikota Estate, Lekki-Ajah Expressway, drove a Range Rover SUV with registration number Lagos CY276LSD on the highway recklessly by driving against oncoming traffic without reasonable consideration to other road users.

According to Agoi, the offence contravenes Section 29 (1) of the Lagos State Traffic Laws, 2003.

He said: “To make matters worse, the accused refused to obey government officials who were trying to stop her from taking the road.”

But the defence counsel, led by Mr. Emeka Okpoko, urged the court to grant her bail on liberal terms since the offence is a bailable one. He said contrary to earlier newspaper publications, the charge before the court showed that the defendant was not the one that killed the LASTMA official.

The magistrate upheld his submission and granted Johnson bail.
In a Black Berry broadcast message yesterday, Johnson’s siblings expressed appreciation to Nigerians for speaking out on the side of truth.

The BB broadcast read: “On behalf of the Daniel (the maiden name of the defendant) family, we sincerely show our gratitude to all of you guys that contributed in the campaign to save Yinka Johnson from the false accusation levelled against her by LASTMA.

“We also appreciate the online eyewitnesses' accounts and those physically present who were courageous enough to stand for the truth without cowering.
“We also appreciate the Nigeria Police for not being biased with their investigations. With such sincerity and truthfulness, Nigeria would be a better place for us.”

According to the banker’s sibling, “For now we are savouring the fact that justice was served. Whether we have plans to sue LASTMA is what we do not know yet, but we are grateful to God for deliverance.”

Many Lagosians had started a campaign for her on Twitter and other social media such as Facebook, Whatsapp, Black Berry messenger and 2go.

Speaking on condition of anonymity, a senior LASTMA officer who preferred anonymity, said they were forced to drop the murder charge against Johnson based on the accounts of eyewitnesses as well as the inconsistencies in LASTMA’s versions of the incident.

He said: “If the woman had not taken one way, Balogun wouldn’t have died.
“I do not think the Ministry of Justice was represented at the court. So the court case was conducted without our knowledge; so I cannot speak much on that but we still maintain our stance.”

When THISDAY inquired to know the next line of action for the banker’s family, perhaps still basking in the euphoria of their relief, they said they are yet to know the next step to take.

But Lagos State Commissioner for Transport, Mr.  Kayode Opeifa, who spoke to THISDAY last night, said: “Whatever the police find out on the matter is what we stand by. They are the appropriate people to carry out investigation and if they say there is no evidence to charge her for murder, then there is no evidence. We stand by that.”

He, however, added: “We don’t have to gloat about this, because somebody has lost his life in the matter. I feel grieved that somebody died. That person has a family too. But if Mrs Johnson is not the one who killed him, then she cannot be charged or punished for an offence she did not commit.”

Some of the spectators who have been following the case from the beginning also expressed pleasure at the exoneration of the banker. They alleged that LASTMA wanted to frame an innocent person for a crime committed by another.

Speaking to THISDAY, Ifeanyi Anwuzie, one of the eyewitnesses, said although the entire incident happened in seconds, people still saw the commercial bus driver hit the LASTMA official.

He said: “The LASTMA officials unknowingly set themselves up as they tried to illustrate to the detectives how the said incident happened. Using objects, they tried to recreate the scene and by so doing proved beyond every reasonable doubt that Johnson could not have used a stationary vehicle with a tow truck in her front to kill the deceased.”

  • It took nearly a week for LASMA to recant their diabolical tale, even with overwhelming eye witness account. What will it benefit these people to punish an innocent person - Ego! God save Nigeria. I can imagine what will happen to Johnson, if she is one of the 'wretch' of this nation.

  • LASTMA Officials should learn to conduct themselves in a respectable manner as they have lost credibility. They are supposed to be proactive but they prefer to be reactive to situations. They have also presented themselves as extortioners and if an opinion poll is taken, 95% of Lagosians will ask for their proscription. Their leaders should train and hire more respectable people to achieve the aim for setting them up.

  • We will need to congratulate the good people of Lagos state for standing by the truth which has now prevailed at long last. However, we should not forget in a hurry the terrible experience of the past few days. We however need to ask ourselves why should LASTMA official have to go to the extend of framing up the banker for a murder charge ? I am asking this question because if not for providence and the tenacity of the good people of Lagos state, the banker would have been languishing in prison custody on the false accusation by LASTMA head of operation and his men.

    The action of the LASTMA head of operation Mr. Asafa and his men has caused terrible damage to the image of LASTMA and by extention to the Lagos state government.

    Now that police investigation has exonerated the banker of the murder charge leveled against her by the LASTMA officials, the police should now be courageous enough to formerly arrest Mr. Asafa and his men and arraign them in court on charges of conspiracy to bring false accusation under section 125 of the criminal code.

    This will go a long way in making sure people are held accountable for their misdeed.

  • I am pleased that justice was done and Mrs. Johnson has been cleared of the trumped up charges; however it must be said that she inadvertently caused the death of another human being, irrespective of whether it was a Latsma official. Had she not knowingly done the wrong thing, all this would not have happened. This begs the question; how do we expect our country to grow,if an educated somewhat affluent individual who under any circumstance should know what's right, goes ahead to do the opposite? I mean, she should have known better and the excuse that she was rushing her sick baby to the hospital is clearly not tenable, as she ended up not at the hospital but in jail.

  • The issue here is that Lastma has mis-informed Nigerians, police, governor & God by alleging that Yinka killed the Balogun! Thus they shld charged to court for giving false information as well as relieving Edu of his duties as GM in lastma, thats what wld happen in a civilised nation like Nigeria. Their excesses has reached a point where Mr. Governor Fashola shld take action & stop defending them. I hope Gov. Amaechi of Rivers is reading this bcos of those touts in TIMRIV.

  • First I join many others to thank God Almighty for His goodness, especially for the sake of that little Johnson (the child) and the other children of Mrs. Yinka Johnson. I also want to join the family in thanking all those who came together to fight this injustice, the Police have really shown that they are actually our friends. The inventors of all the social networks also really deserves our thanks. The world looks as if it is certainly coming to an end. The wickedness of man to man seem to be skyrocketing by the day. From Boko Harams to Pension Scam, to Fuel Subsidy Scam, to kidnappers, etc now to LASTMA. I think we should add "N" to LASTMA to make it LASTMAN so that they will be left only in Lagos. What do we really expect from them? Agberos in uniform.
    This is a wake-up call to our Governor and the Management of all Lagos State Law Enforcement Agents for proper Training and Re-training. Providing job does not mean hiring people who are mentally not fit to do the job. The State Government can open Car Wash and things related to the levels of these people and hire them to work there.
    I can testify to the effectiveness of LASTMA when they first started but they have lost it, and that is the basic fact which the government must accept.
    Lastly I sincerely do sympathize with the family of the deceased official. For his sake, LASTMA Management should do something to remember him by ensuring that they do their job properly.
    LASTMA Management owe us Nigerians, especially Lagosians an open apology for calling us fools openly by their false claims. Once again I thank God Almighty and whether or not Mrs. Yinka Johnson is a Catholic, I most especially today (The Assumption of our Mother Mary) also thank our Mother Mary as some of us most have called for her help.

  • In addition to my earlier comments, I ask all of us to please abide by the simple traffic law. It surely will save us all from embarrassment. If we do, then may be the LASTMA officials will nolonger have work to do and they will taken off our roads. Until we join hands to make Lagos State a law abiding City like we here people say about "America" etc we will not only continue to create problems not just for our selves, but our families and friends out there. The Laws are SIMPLE.

  • It is just unfortunate that many commentator did not see beyond that Yinka was alleged to have killed the officer, her action beget the killing, in my sincere opinion if she had not taken one way may be the officer may still be alive today and this will serve as a lesson to everybody that you must ready to take responsible for your action.

  • I don't care who "Yinka Johnson" is. The fact of the matter is that she drove against traffic and the attempt by LASTMA to stop/arrest her led to this whole saga. We/Lagosians are always in a hurry to get to our/their destinations. We should learn to obey simple laws of the land and the State/Country/Society will be better.

  • The Daniel family shld thank the Igbo race for their boldness in defending whatever they believe in. All the Yoruba pple that were there when the incident took place did not come to defend their own. Also kudos to the police investigator who's also an igbo man for not collecting bribe from the Lastma pple and convict the innocent nursing woman. A Yoruba man investigating a case against an Igbo person wld hv find a way to convict that woman. That's Nija for us
